By accessing or using the ExSafe B2B Portal ("Portal") operated by BARTEC Safety (Pty) Ltd, a company incorporated in the Republic of South Africa (Registration No. to be confirmed), you ("User") agree to be bound by these Terms of Use. If you do not agree, you must immediately cease use of the Portal. These Terms are governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Consumer Protection Act 68 of 2008 ("CPA") where applicable, and the Protection of Personal Information Act 4 of 2013 ("POPIA").
The Portal is a business-to-business (B2B) platform intended exclusively for authorised commercial entities and their nominated representatives. Access is granted by invitation only. You warrant that you have full authority to bind the entity on whose behalf you act and that all information provided is accurate and current. Unauthorised access, sharing of credentials, or use of the Portal for any purpose other than tracking and managing orders placed with BARTEC Safety (Pty) Ltd is strictly prohibited.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. You must notify BARTEC Safety (Pty) Ltd immediately at support@bartec.co.za if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate access if we reasonably believe a security breach has occurred or that these Terms have been violated.
The Portal may only be used for lawful purposes in connection with your existing commercial relationship with BARTEC Safety (Pty) Ltd. You agree not to:
Order information displayed on the Portal is provided for informational purposes and reflects data captured by BARTEC Safety (Pty) Ltd. While we endeavour to maintain accurate and up-to-date records, we do not warrant that information is error-free. Any discrepancies should be reported to your BARTEC Safety account manager or to support@bartec.co.za promptly. The Portal does not constitute a legally binding offer or acceptance of any commercial contract; all contractual terms are governed by separately concluded purchase orders and agreements.
All content on the Portal, including but not limited to software, text, logos, graphics, and design, is the intellectual property of BARTEC Safety (Pty) Ltd or its licensors and is protected under South African copyright and intellectual property law. No licence to use such content is granted except as strictly necessary to use the Portal in accordance with these Terms.
To the fullest extent permitted by applicable South African law, BARTEC Safety (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of or inability to use the Portal, including loss of data, revenue, or business opportunity. Our total aggregate liability arising from or related to these Terms shall not exceed the rand value of orders placed through the Portal in the three (3) months preceding the claim. Nothing in these Terms limits liability for fraud or gross negligence.
The Portal may rely on or link to third-party services (e.g., logistics carriers, courier providers). BARTEC Safety (Pty) Ltd does not control such third-party platforms and accepts no liability for their content, availability, or practices. Use of third-party services is at your own risk and subject to those parties' own terms.
We endeavour to maintain Portal availability but do not guarantee uninterrupted access. The Portal may be taken offline for maintenance, updates, or due to circumstances beyond our reasonable control (force majeure). We shall not be liable for any loss resulting from temporary unavailability.
BARTEC Safety (Pty) Ltd reserves the right to amend these Terms at any time. Continued use of the Portal after notification of changes constitutes acceptance of the amended Terms. We will endeavour to notify registered users of material changes via the email address associated with their account.
We may suspend or terminate your access to the Portal at any time, without notice, if we believe you have violated these Terms or if it is necessary to protect the integrity of the Portal or the interests of other users. You may request deactivation of your account at any time by contacting support@bartec.co.za.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa. The parties agree to attempt to resolve any dispute in good faith before initiating formal legal proceedings.
